Clutch App Terms and Conditions

By downloading, accessing, or using the Clutch mobile application (“App”), you accept and agree to these Terms and the applicable Privacy Policy. Your use of the App is expressly conditioned on your acceptance of these Terms.

If you do not agree, you must stop using the App immediately.

Acknowledgement: You acknowledge that these Terms are concluded between you and Clutch only, and not with Apple Inc. Clutch, not Apple, is solely responsible for the App and the content thereof.

Maintenance and Support: Clutch is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services.

Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions, Apple will have the right to enforce these Terms against you as a third-party beneficiary thereof.

If you purchase an auto-renewable subscription within the App:

Clutch grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use on any Apple-branded products that you own or control.

You may not:

You must be at least 16 years old to use the App.

You represent that you are not located in a country that is subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you are not listed on any U.S. Government list of prohibited or restricted parties.

You are responsible for providing accurate information and maintaining account security.

Assumption of Risk: Clutch does not guarantee the accuracy, safety, or suitability of user-generated routes or third-party events. You assume all risks associated with participating in activities referenced in the App.

Content Licence: You retain ownership of content you submit, but grant Clutch a non-exclusive, royalty-free, perpetual licence to use and distribute such content for operational and promotional purposes.

Ratings: User ratings are public and may be moderated at Clutch’s discretion.

Your use of the App is governed by our Privacy Policy.

Clutch processes personal data in compliance with UK GDPR.

We retain ownership of all platform data and aggregated insights.

All rights, title, and interest in the App, including software, design, and marks, are owned by Clutch.

You may not use Clutch’s intellectual property without express permission.

"As Is": The App is provided “as is” and “as available” without warranties of any kind.

Liability: To the extent permitted by law, Clutch’s total liability shall not exceed the amount you have paid (if any) for the App in the 12 months preceding the claim.

Product Claims: Clutch, not Apple, is responsible for addressing any claims of the user or any third party relating to the App or the user’s possession and/or use of that App.

We may suspend or terminate your access to the App at any time, for any reason, without notice.

Upon termination, all licences granted to you will end.

These Terms are governed by the laws of England and Wales.

Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
